Subject: Discrimination Exposed – ROR for 10.53 Acres as Gharabari to M/s Acrux after Govt lost SLP, but 0.05 dec denied to poor senior citizens – Why Gen X Movement in Bhubaneswar.

*Respected Sir,

We are thousands of senior citizens of Bhubaneswar, lawful owners of leasehold land in Pathargadia Mouza, yet are forced to live in rented houses in old age. Due to this step-motherly attitude, we are compelled to start a citizens’ initiative – ‘Gen X Movement’ for justice.

We state that recently ROR No.685/9 issued to M/s ACRUX REALCON PVT LTD for 11 plots – Ac.10.5300 dec (4.2615 Hect), Mouza- Gothapatna, Bhubaneswar. *Kissam in all 11 plots – Gharabari.

The ROR itself records:

“Correction has been done as per order of Hon’ble Supreme Court in SLP Nos.14553-14554/2020 dt 27.11.2020 and Hon’ble High Court WP(C)20269/2017 dt 11.12.2019 and Hon’ble Supreme Court Review Diary No.(S)1068/2021 dt 08.07.2021 and observation dt 07.08.2021 of LR-cum-Spl Secretary, Law Department, communicated by Revenue Dept vide letter No.25701/26.08.2021.”

Thus, after the Government lost SLP and Review Petition in Supreme Court, Tahasildar, Bhubaneswar regularized 10.53 acres and converted Kissam to Gharabari for a powerful builder.

But the same Tahasildar denies issue of RoR and conversion of 0.055 to 0.080 dec to Gharabari for poor pensioners who have Draft Parcha issued by Settlement Authority and clear High Court orders in their favour. Is law different for a builder and different for a 71-year-old senior citizen? This violates Article 14.

Our grievances in detail:

  1. Non-finalization of Parcha: During settlement, ASO issued Parcha [Draft Patta] in all cases in Pathargadia. As per law, if no objection is received within 3 months including from Government, Parcha must be finalized. This is affirmed by Hon’ble High Court in Shakuntala Dash Vs State [WP(C)11912/2017] and Padmanava Prusty Vs State [WP(C)12776/2014]. State accepted these judgments and did not file SLP. Despite this, in majority cases Parcha was neither finalized nor rejected and land was illegally recorded as Government land. In few similar cases, Patta was issued. This pick-and-choose is arbitrary.
  2. Selective SLPs after losing in Supreme Court: While High Court orders were implemented in many cases, SLPs were filed selectively. In Acrux case, Government filed SLP Nos.14553-14554/2020 and lost, then filed Review No.1068/2021 and lost again, and finally implemented the order. Now in identical matter WP(C)1608/2014, and few others after Supreme Court remanded the case, High Court again gave a clear-cut verdict in favour of senior citizen. Revenue Department is again proposing to file selective SLP in this case and many other similar cases of 0.05 dec. Since the Supreme Court has already decided against Government in similar leasehold regularization matter, there is no legal justification to approach SC again. All such proposals must be withdrawn to ensure uniform law.
  3. Discrimination in Kissam conversion: For Acrux, all 11 plots converted to Gharabari. For senior citizens, even where Tahasildar issued Patta as Sthitiban as per High Court orders, Kissam is retained as Baje Fasal/Agriculture. Due to this, BDA/BMC denies building plan approval. OLR Appeals before ADM, Bhubaneswar are pending for more than 3 years without disposal.

PRAYER:

It is therefore prayed that Revenue Department may kindly be directed to:

a) Ensure uniform, time-bound implementation of all High Court and Supreme Court orders as done in Acrux case, without discrimination;

b) Expedite finalization of all Parchas where no objection was received within 3 months;

c) Direct Tahasildar/ADM, Bhubaneswar to uniformly convert Kissam to Gharabari in all Sthitiban cases in BDA approved area like in Acrux case;

d) Dispose all pending OLR Appeals before ADM within 15 days;

e) Withdraw proposal for filing selective SLP in WP(C)1608/2014 and other similar cases as Government has already lost SLP Nos.14553/2020 on same issue;

f) Dispense with fresh physical verification as Settlement Amin has already verified possession and maps.

Sir, early intervention will save thousands of senior citizens from financial and mental distress and prevent public agitation under Gen X Movement.
