All members are requested to urgently review this draft and provide suggestions/inputs so that the Secretary General may finalize and submit a comprehensive response on the MyGov portal before 31.03.2026.
Pensioner-Centric Submission to 8th CPC
This submission focuses exclusively on pensioners, who are fully dependent on pension for survival and dignity.
Guiding Principle (Q1–Q2)
Pension is deferred wage and a legal right, not a concession.
Citations:
• D.S. Nakara vs UOI (1983) – pension is a right
• Deokinandan Prasad (1971) – enforceable legal right
• Jitendra Kumar Srivastava (2013) – property under Article 300A
• V. Kasturi (1998) – must be fair and non-arbitrary
Demand: Ensure dignity, social security, and protection from inflation.
Parity (Q3)
No discrimination among pensioners.
Citation: Nakara (1983) – no arbitrary classification
Demand: Full parity between past and future pensioners.
- Fitment Factor (Q6)
Demand: Minimum 2.86–3.50
Reason: Severe erosion due to inflation; no income growth avenues.
- Increment to Pensioners (Q9)
Demand: Annual increment of 5% or periodic revision.
Reason: Pension as deferred pay must grow to offset inflation.
- LTC for Pensioners (Q10)
Demand: Introduce LTC for pensioners.
Reason: Promotes well-being and inclusion.
- Pension Revision (Q11)
Demand:
• Based on last pay drawn
• Automatic revision with CPC
• OROP-type parity for all civil pensioners
- Medical Benefits
Demand:
• Increase FMA
• CGHS in every district
• All private hospitals empanelled
• Full government-funded insurance
Reason: Right to health under Article 21; high elderly medical costs.
- Minimum Pension
Demand: ₹40,000.00 per month
Reason: Need-based living standard and inflation.
- Universal Coverage
Include all 69 lakh pensioners with uniform benefits and no anomalies.
Conclusion
Pension is a constitutional, legal, and moral obligation. The 8th CPC must ensure dignity, parity, and economic security for all pensioners. Pension should be exempted from payment of income tax. Restoration of commuted pension should be within ten years.

For sl.no.4,on periodic revision/ increment,can we repeat the demand for hike at age of 65,70,75,80 etc @5% replacement of present 20% given at 80 years ..In other words ,hike of 5% after every 5 years replacing present hike after attaining age of 80,90 ,100 etc ..An alternate approach.. that’s all.
Commutation of pension may be allowed after first commutation is over. The pensioner can avail first commutation at the time of retirement. The applicable amount is deducted for fifteen years. It is requested that after that the pensioner may be allowed to get second time commutation. The repayment or recovery period maybe shorten ie for 8 years or 10 years. This helps pensioner get advance or loan with ease. Secondly the interest rate on recovery may please be reduced to 8%
The minimum pension of Rs.40,000/-suggested is good. But it is more than the suggested fitment factor of 2.86-3.50to the existing minimum pension of Rs.9000/-

Family pension should be alllowed at 100% for at least 7 years after the death of a pensioner.dependent spouse is left at miserable financial status.
There are anomalies happening in the pay commission report due to mistakes committed while compiling the report .while it is being rectified subsequently the date of implimentations should be the date on which the parliament had made it effective in the bill and should not be given on prospective date as such shift of date is denial of benefits compared to those who had already got the benefits,amounting to violation of fundamental rights of equality.
Inspite of some case concerning 5th pay commission, Supreme court, high courts ,tribunals had held on manifold times that the effective date of implementation of the pay commission should be the date on which the bill was passed by the parliament giving the effective date, the ministry is asking the staff especially pensioners and widow pensioners to approach the courts to get similar judgement which was already held by the Supreme court.This matter should be settled by the concerned ministries as it is a similarly placed issue ,being upheld by the Supreme court of india and should be decided by the ministries without asking the pensioners, widow pensioners to go to the court ,spending lot of money and time to avail of the benefits.
It is paramount to note that in the usual course enforcement of pay commission orders, no staff or pensioners are asking in writing to give the benefits as it is the wish of parliament of india enacted as a bill to bestow benefits to the servants of the govt of india,for rendering valuable service to the nation.so irrespective of the fact any one asked it or not, ministries should extend these benefits to one and all without waiting for anyone to apply for it or anyone getting a court order.
