Subject: Humble request for your kind intervention and appropriate review of the functioning of certain Departments of the Government of Odisha concerning persistent failure in citizen grievance redressal, land-record regularisation, selective litigation against citizens and non-uniform implementation of judicial orders — Proposal for a peaceful and democratic “Gen Z (Old)” Movement of Senior Citizens and Pensioners in Bhubaneswar.
Respected Hon’ble Prime Minister Sir,
With profound respect and full faith in the constitutional institutions of our country, I most humbly submit this representation seeking your kind intervention in certain serious and continuing difficulties faced by common citizens of Odisha, particularly senior citizens, pensioners, retired employees and economically weaker landholders.
The people of Odisha reposed faith in democratic governance with the hope that long-pending grievances would be resolved with sensitivity, transparency and accountability. However, in numerous cases relating to land records, settlement, Kissam conversion and finalisation of Parchas, citizens are being forced into prolonged litigation despite having lawful documents and favourable judicial orders.
- Complete breakdown of Citizen Grievance Redressal Mechanism
A democratic government derives its strength from citizen confidence.
a) Departmental Emails: Thousands of grievances sent to official IDs remain unacknowledged. No speaking reply or resolution is furnished.
b) CPGRAMS: Despite PMO guidelines, complaints are often closed without addressing the core issue. For senior citizens and pensioners who cannot visit offices repeatedly, this creates immense hardship.
I therefore humbly request an objective factual report on CPGRAMS pendency and quality of disposal in Odisha, with special focus on cases of senior citizens and pensioners.
- Precarious state of Revenue & Disaster Management Department
For a senior citizen, a small piece of land represents life-long savings and hope for a home in old age.
Despite acceptance of Government rent for years, issuance of Patta/RoR and recognition as Raiyat/Sthitiban, consequential correction of Kissam is not being done uniformly.
This forces citizens to remain lawful owners on paper but without the ability to construct a house or obtain building plan approval. - Selective and repeated litigation — Urgent need for withdrawal of proposal to file SLP in W.P.(C) No. 1608 of 2014
It is respectfully submitted that the State has a right to file SLP where substantial questions of law are involved. However, the present proposal to file SLP against the judgment in W.P.(C) No. 1608 of 2014 and other connected matters concerning Pathargadia Mouza is discriminatory, legally weak and causes grave injustice.
Justification for withdrawal:
- Settled legal position: The Hon’ble High Court has already held that in absence of traceable lease records and absence of proof that lease was for agricultural purpose, the State cannot presume “Baje Fasal” status. To challenge this settled position through SLP will only prolong litigation.
- Selective targeting: In identically situated cases involving influential estate holders, High Court orders have been implemented. But in cases of poor citizens, senior citizens and pensioners, the State proposes to file SLP. This creates a clear perception of discrimination violative of Article 14.
- Waste of public resources: Filing SLP in a weak case will result in avoidable expenditure of public money, and force elderly litigants to defend their rights from High Court to Supreme Court at an advanced age.
- Binding precedent: Hon’ble Supreme Court has already dismissed similar SLPs filed by the State of Odisha in other matters and has remanded cases back to High Court. Filing another SLP in W.P.(C) No. 1608 of 2014 will lead to the same result and only add to pendency.
In view of the above, I most respectfully pray that the proposal to file SLP in W.P.(C) No. 1608 of 2014 and connected matters on a selective basis against poor citizens and senior citizens be withdrawn immediately in public interest.
- Pathargadia Mouza, Bhubaneswar — Illustrative case
During settlement, Assistant Settlement Officer issued “Parcha” in Pathargadia and other mouzas. As per law, if no objection is filed within 3 months, the Parcha is to be finalized. No objection was filed by anyone including the Government. Yet, instead of approval, the land has been recorded in the name of Government.
The Hon’ble High Court in several cases has directed finalization of such Parchas. But benefits are not being extended uniformly.
- Non-uniform conversion of Kissam to “Gharabari” — Direction to ADM, Bhubaneswar
After High Court orders, the Tahasildar has issued Pattas with “Sthitiban” status in several cases. In some cases Kissam has been changed to “Gharabari”, but in other identical cases, including OLR Appeal cases pending before ADM, Bhubaneswar, such conversion is being denied.
This selective denial makes the land unusable for residential purpose despite the citizen being the lawful Pattadar. For a senior citizen aged 70-80 years, this amounts to denial of shelter and dignity.
Therefore, I humbly pray that the Additional District Magistrate, Bhubaneswar be directed to:
Pass appropriate orders in all pending OLR Appeal cases to change the Kissam from “Baje Fasal-II” to “Gharabari” wherever the High Court has recognized “Sthitiban” status and where no objection was filed during settlement, so that similarly situated citizens receive uniform treatment.
- The plight of Senior Citizens and Pensioners
Many affected persons are aged 65 to 80 years. They have paid taxes all their lives. At this age they cannot run from court to court. Justice delayed for them is justice denied. A special time-bound mechanism is required for disposal of their cases. - Proposal for “GEN Z (OLD) — SENIOR CITIZENS & PENSIONERS MOVEMENT”
If grievances remain unresolved, citizens will be compelled to launch a peaceful, democratic, non-political “Gen Z (Old)” Movement. The intent is not confrontation but to remind the administration that senior citizens deserve dignity, finality and equal treatment under law.

HUMBLE PRAYER
In view of the above, I most respectfully pray that your good self may kindly:
- Cause a review of the functioning of Revenue & Disaster Management Department and Law Department of Odisha on grievance redressal and litigation policy;
- Obtain a factual report on CPGRAMS disposal in Odisha with focus on senior citizens;
- Direct that all citizen grievances receive reasoned, speaking and time-bound replies within 30 days;
- Direct immediate withdrawal of the proposal to file SLP in W.P.(C) No. 1608 of 2014 and other connected Pathargadia cases on selective basis against poor citizens and senior citizens;
- Direct the Additional District Magistrate, Bhubaneswar to dispose of all pending OLR Appeal cases by directing change of Kissam to “Gharabari” in cases where “Sthitiban” status has been recognized by Hon’ble High Court;
- Direct uniform implementation of High Court judgments and finalization of all pending Parchas issued during settlement, including Pathargadia Mouza;
- Constitute a special mechanism for expeditious disposal of land cases involving senior citizens and pensioners above 60 years; and
- Ensure that the spirit of “Sabka Saath, Sabka Vikas, Sabka Vishwas, Sabka Prayas” reaches the last citizen standing before a Government office.
